The authors consider the problem of bringing bankruptcy of persons controlling the debtor to subsidiary liability. Indicate the inappropriateness of assigning to the arbitration court judge the obligation to conduct a comprehensive economic analysis of the state of the debtor in various periods. They note the uncertainty of the content of such categories as standards of managerial practice, normal business practices, and an economically sound plan. They propose to lift the ban on attracting arbitration assessors in insolvency cases, to allow them to participate in cases on bringing to subsidiary liability at the request of the person participating in the case.
