Actual problems of forensic expert activity in the Russian Federation

The relevance of the topic of the article lies in the fact that currently high rates of appointment of forensic examinations are recorded. The article reveals the problems of the organizational and legal order that hinder large-scale scientific research in this area. Attention is drawn to the need for urgent and mutually ordered improvement of sectoral procedural legislation, in terms of regulating the use of special knowledge for the purposes of legal proceedings, and basic legislation on forensic expertise. An integral element of the investigation of crimes is the forensic and forensic activities. Without criminalistics and special knowledge implemented in the form of forensic examinations, the pre-trial stage of criminal proceedings is simply unthinkable. At the same time, the quality of the investigation of each criminal act directly depends on the legal, organizational, scientific-technical and scientific-methodological support of forensic and forensic activities. Meanwhile, at the present time, not everything in this part is properly provided at the state level. In this regard, a set of key problems has matured that, in our opinion, require solutions today. First of all, it is necessary to note the need for full-fledged regulation of the activities of non-state forensic experts. It is noteworthy that the modern legal basis of state forensic expert activity is represented by the Constitution of the Russian Federation, a whole list of procedural codes, Federal Law No. 73-FZ of 31.05.2001 “On State Forensic expert Activity”, a number of other federal laws and regulatory legal acts. This allows us to talk about the fact that, in general, the activities of state forensic experts are sufficiently fully regulated by interrelated legal acts, starting from the requirements for their qualifications, equipment and methodological support and ending with the procedure for appointing and conducting examinations, issuing expert opinions, storing research objects, etc.
