Actual problems arising in the appointment, production and estimated results of complex expert examinations

The article is devoted to one of the most important institutions of the criminal process - the Institute of complex forensic examination. The main features of a comprehensive forensic examination in criminal cases related to road traffic crimes are highlighted and emphasized. The paper analyzes some problematic aspects of this type of expertise that arise during the appointment, production and evaluation of the results of complex expert examinations. The expert and investigative practice in criminal cases related to road traffic crimes is analyzed. Particular attention in this article is paid to the timing of complex forensic examinations. Attention is drawn to the subjects of complex forensic examinations in criminal cases of this category. The article deals with the tactical and organizational issues of appointment and conduct of complex forensic examinations, selection of an expert and an expert institution. The author describes the problems that arise during the formation and indication of the initial data in the decisions on the appointment of complex forensic examinations; determines the procedure for raising questions before experts, the number of questions posed. The author highlights the features considered by the author during the inspection of vehicles by forensic experts, their transportation to an expert institution or on the territory of a specialized territory intended for storage and preservation in criminal cases of this category. The author considers the question of the participation of a specialist in investigative actions in criminal cases of this category. This article focuses on the location of complex expert examinations, the definition of an “expert organizer” and his role in the production of complex expert examinations. The proposals on the introduction of individual amendments and additions to the current criminal procedure legislation are substantiated. Attention is focused on the improvement of methods for the purpose, production and evaluation of the results of complex expert examinations in criminal cases related to road traffic crimes. The importance of complex expert examinations is emphasized, the production of which will ensure the receipt of results for giving reasonable conclusions on criminal cases of this category. This article examines the points of view of various forensic scientists on the content and concept of complex expert examinations.
