Alimentary obligations in Russia at the present stage: legal aspect

The actual problem in the modern Russian society is the fulfillment of alimentary obligations by citizens who, in accordance with the law, are obliged to pay such maintenance. In recent years, the state has taken various measures to combat alimentary obligations evasion, but the number of alimentary non-payers is still high. At the present stage, such an institution as an agreement on alimentary payment remains ineffective in the Russian Federation, although the procedure for entering into, enforcing, terminating and invalidating this agreement is clearly regulated in the Family Code of the Russian Federation. This situation is connected also to the unwillingness of the person obliged to alimentary payments to fulfill this duty. The author mentions making amendments to the Family Code of the Russian Federation as one of the ways to change the situation. These amendments are based on scientific proposals and related to binding to apply to court the parent with whom the child lives and who refuses to make an agreement on alimentary payment or to apply to court to recover maintenance. The author concludes that it is necessary to create a state alimentary fund, which provides support to those recipients of maintenance who do not receive it because of alimentary obligations evasion by persons obliged to alimentary payments to support minors and adult incapable citizens.
