The summary: In the article the problems of legal regulation of banking and commercial secrets is revealed and analyzed. The gaps in modern Russian legislation in this sphere are pointed out. The judicial practice in cases of offences in the sphere of banking and commercial secrets are investigated. The tendencies in the law of some foreign countries in the field of legal regulation of banking secret by prevailing in the midst of the global financial crisis are marked.
