In the last decade, unmanned aerial vehicles have been used in many sectors of the national economy. The rapid technical development of unmanned aerial vehicles is associated with their use in combat actions during a special military operation. Drones have also found their use in criminal activities, as an effective means of committing crimes and, accordingly, have themselves become the subjects of criminal encroachments. Consideration of the characteristics of the UAV as the subject of a crime will allow to give an adequate interpretation of its signs and will allow to remove the emerging issues of qualification of criminal acts, especially in the light of the additions and amendments made by the Russian legislator to the Air Code of the Russian Federation.
