The circumstances aggravating the measures of criminal punishment are legally fixed facts indicating a special degree of public danger of the committed criminal act and the identity of the perpetrator of the committed act, which makes it possible to assign the most severe measure of criminal punishment. The analysis of the concept of aggravating circumstances allows us to identify specific characteristics of aggravating circumstances: - these circumstances are regulated by the materials of the criminal case; - aggravating circumstances are beyond the scope of the criminal act.
