The article examines the problem of unfair behavior of participants in insolvency (bankruptcy) cases, analyzes the judicial practice of arbitration courts on issuing private rulings in such cases on the following grounds: unfair behavior of participants in cases, bringing arbitration managers to administrative responsibility for identified violations, etc. The author comes to the conclusion that, in general, arbitration courts in insolvency (bankruptcy) cases fully implement the provisions of Article188.1 of the Arbitration procedure code of the Russian Federation, but certain changes need to be made to it.
