Digital transformation is an integral part of the modern world, which contributes to the economic growth of many countries. One of the key principles of law is its dynamism, which ensures that it develops in step with technological progress. Obviously, the judiciary cannot afford to remain unchanged in a constantly and rapidly changing world. There is a need to integrate digital technology into the evidence system of civil proceedings. This study is devoted to the impact of digitalization on the development of the evidentiary process in civil proceedings. In the era of the formation of information society, judicial resolution of disputes on the protection of digital rights of citizens is of paramount importance, This article analyzes not only the legal regulation of such proceedings, but also the process of proving and considering such electronic evidence in civil proceedings. Relying on international and domestic experience, additional arguments are given in favor of the fact that electronic evidence, regardless of its autonomous fixation in the current procedural legislation, can and should be used in the consideration and resolution of civil cases along with written, physical and other traditional means of evidence. Electronic evidence fully complies with the basic criteria that characterize any evidence in modern civil proceedings. Only subject to effective and fair evidence is it possible to ensure proper protection of the rights and interests of all participants of civil proceedings. Digitalization of justice using advanced IT solutions opens up new horizons in the field of evidentiary process.
