Digitalization of Bankruptcy Procedures: Legal Problems of Implementing Artifi cial Intelligence and Blockchain Technologies in the Institution of Insolvency

A comprehensive analysis of the legal problems of implementing artificial intelligence and blockchain technologies in bankruptcy procedures has been carried out in order to determine the directions for improving the legislative regulation of the institution of insolvency in the context of digitalization. The issues of the legal status of evidence obtained using artificial intelligence, the legal force of records in distributed ledgers, and the legal regime of crypto assets in the bankruptcy estate have been investigated. The judicial practice of the Russian Federation on the application of digital technologies in bankruptcy procedures has been analyzed, and contradictory approaches of courts to the assessment of digital evidence have been identified. A comparative analysis of foreign experience in the legal regulation of the application of artificial intelligence and blockchain technologies in insolvency procedures in the USA, Singapore, Estonia and the United Kingdom has been conducted. Based on the study, recommendations have been developed for improving bankruptcy legislation, including the creation of a legal framework for the use of digital technologies, the establishment of requirements for artificial intelligence algorithms, the determination of the status of crypto assets, and the formation of a national digital infrastructure for bankruptcy procedures.
