The article critically analyzes the doctrinal approaches to the definition of the concept of «subjects of proof», expressed in the modern theory of the criminal process. It reveals its relationship with the definition of «burden of proof». Attention is paid to the causes of fundamental contradictions in the views of scientists regarding the definition of the analyzed concept.
