Active repentance as a general prerequisite for the formation of grounds for exemption from criminal liability

The article examines the concept and signs of active repentance, analyzes the grounds for recognizing the behavior of the guilty person as repentant. The author proposes amendments to the criminal legislation of the Russian Federation to create a uniform approach to understanding the grounds for exemption from criminal liability. It is proposed to create a common system for the application of grounds for exemption from criminal liability, as well as to combine the procedures for exemption from liability to bring the studied norms to the general principle of implementing the provisions of the criminal law.
