Money and monetary liabilities as a problem of the theory of modern civil law

In the article the author considers the main economic and legal theories of money, analyzes some practical problems and features of money, money turnover and money circulation. It is noted that in the legal science there are many different theories about the legal nature and legal regime of money, but the legislator does not always perceive modern theoretical concepts and therefore in the current civil legislation continue to be formal legal grounds for a double interpretation of the concept of "money". Considering the problems of money dualism and analyzing the subject of the discussion of the civilists about the owner of money, the author comes to the conclusions about the relevance and necessity at the legislative level to exclude the possibility of double interpretation of the concept of "money", to change the ways of protection for monetary obligations and to develop a unified inter-sectoral economic and legal theory of money.
