The article deals with legal problems arising in the field of trade marks, especially relating to the early termination of legal protection of such marks. The author notes that it is not always advisable to discontinue mark protection, as it does not correspond to the prevailing socio-economic relations, and offers two ways to resolve the identified problems - the introduction of a compulsory license or the introduction of a grace period for the owner.
