The formation of the jury under regulations of criminal proceedings of 1864

Purpose: To study the procedure of the formation of the jury in a pre-revolutionary Russia. Methodology: Historical-legal and technical methods were used. Results: The article deals with the procedure of the formation of the jury under Regulations of Criminal Proceedings of 1864. In particular there is an examination of the preparatory steps of the court under this procedure, orders of the President of the court, the period of meetings’ opening with jurymembers, drafting of the presence of jurors. Special attention is paid to such stage in the formation of the Board as the drafting of the presence of jurors. It is noted for which reasons the jury could be released from the performance of their duties, with which powers they were lodged for picking the gallery in a particular criminal case, how the jury was sworn and in which cases a complete jury was replaced on a talesman. The legal positions of the Senate on the formation of the jury are given in this article. Novelty/originality/value: Article possesses a high scientific value, as it comprehensively discusses the whole procedure of the formation of the jury, which existed in a pre-revolutionary Russia.
