The formation of the regulatory legal relations arising in connection with the regulation of oil transportation through oil pipeline system in the Russian Federation

This article reveals topical issues of legal regulation of relations connected with oil transportation, carried out through the use of pipeline transport in the Russian Federation. The stated circumstances will allow arguing the relevance of the problems of this research topic. The object of this research is a set of legal relations, regulating the supply of oil and petroleum products by pipeline transport in Russia, affecting features of these relations. The subject of this research is served the legal norms, devoted the legal regulation of the supply of oil and petroleum products by pipeline transport in Russia. Now, oil and petroleum products are one of the major natural resources without which it is impossible to imagine the life support of all mankind as a whole. These benefits are playing a fundamental role in the development of certain states; they have a direct impact on the economy and the conduct of policy. Oil is the blood in the vessels of the urbanized communities. The trunk pipeline is a difficult, complex mechanism; in addition to the “pipe” it includes a number of facilities, ensuring safe and efficient transportation of hydrocarbon raw materials. For civil turnover ensuring the trunk pipeline should be considered as an enterprise, the property complex, used for entrepreneurial activities implementation. Poor development of legislation in this area is considered to be one of the reasons of numerous discussions when determining the legal nature of the relations, connected with oil transportation by pipeline transport. The current scientific positions on these issues are provided the basis for the development and justification of new statutory provisions. Any law-making process (in relation to the development of separate normative acts) should include as a mandatory stage of scientific elaboration of issues to be solved, including the reinterpretation of existing provisions. A characteristic feature of legal regulation of public relations is the lack of a special law in this industry, regulating public relations in this industry exactly. Consideration of the structure and content features will give the chance to find ways of improving of the relations, connected with oil transportation.
