Forms of implementation of criminal law norms: general theoretical aspect

The article from the standpoint of the general theory of law and theory of criminal law deals with the implementation of criminal law and its relationship to lawful behavior, forms of realization of criminal law: use, performance, compliance and application. Use is the commission of actions permitted by criminal law, both active and passive forms of behavior are possible, in this form, the governing norms of criminal law are implemented. The execution of criminal law norms is a form of implementation in which the subject is obliged to perform certain active actions provided for by criminal law norms, involves the active activity of subjects in the process of which binding criminal law norms are implemented. Compliance with the criminal law - a form of implementation, in which the person should refrain from prohibited under the criminal law of the steps required passive form of behaviour, the form is implemented, the vast majority of the norms of the Special part of the Criminal code of Russian Federation. A special form of implementation of criminal law norms is their application, which in its essence acts as a state-power activity, through which the relationship between state bodies and the person who committed the crime is established.
