The authors analyze the genesis of the institution of ownership in Roman law, foreign legislation (on the example of Germany) and in Russia. Explore the main provisions of the normative legal acts that regulated the institution of ownership in the relevant historical periods. They come to the conclusion that it is currently required to amend the norms of Russian legislation relating to this legal sphere.
