Characteristic of violence in power capture

The article is devoted to the analysis of the content and definition of violence in criminal law, as well as its characteristics in relation to the seizure of power. The author notes that violence against the state differs in relation to the individual by overcoming the will of not an individual person, but the will of all the people living in him (refraction, overcoming, suppression of the will of the people). This type of violence is manifested in the impact on political institutions and state bodies formed in accordance with the procedure established by law. Analytical work has been carried out to determine the forms and types of violent seizure of power, changes to the current legislation have been proposed, and the necessity of issuing guidance clarifications of the Supreme Court of Russia has been substantiated.
