The property relations of spouses and hereditary problems as a business risk source

The authors of the article consider the possible risks of an undesirable division of a business when dividing property of spouses, including at the request of creditors of the debtor spouse and during inheritance. It analyzes the practice of arbitration courts and courts of general jurisdiction in disputes between spouses and heirs concerning the fate of stakes in the charter capital of LLCs and shares. Ways are proposed to protect the business from involuntary changes in the composition of owners by using a combination of legal instruments.
