Purchasing from a single supplier is a non-competitive form of defining a supplier (contractor, performer), in which the latter is selected without a formal selection procedure. One of the major problems in the implementation of procurement from a single supplier is so-called “split procurement” or downscaling of an order, which is often used by customers to simplify the procedure or enter a contract with an affiliated supplier. This, of course, violates competitive procedures for public procurement. The unbundling of the procurement with a view to “issuing” it for procurement from a single supplier violates the provisions of a number of regulatory acts. So, with a detailed check of contracts concluded by the customer according to “crushing methodology”, one can see the violation of article 34 of the Budget Code of Russia. Considering the disaggregation of procurement from the point of view of the Civil Code, one can see the signs of feigned transaction. Fragmentation of procurement also violates the law on the protection of competition...
