Sexual relations as a form of realisation of private life. Legal regulation in Russia

The article highlights the issues of legislative regulation of traditional and non-traditional sexual relations, discrimination based on sexual orientation, legal regulation of propaganda of nontraditional sexual relations. Current constitutional and the Supreme court of the Russian Federation regarding the regulation of the right to privacy and the right to information, Decisions of the European court of human rights, development trends of the Russian legislation are analysed. The presence of discrimination in the Russian society depending on sexual orientation, justification of existing law enforcement practices in national legislation and judicial acts, the contrast between national and international law is indicated. It is offered to recognise steps to the deliberate dissemination of information that could cause harm to the physical or mental health of minors as propaganda (when defining the formal elements of the offense). The responsibility should occur for negative information which may cause harm to the physical or mental health of minors, and not for the promotion of the information that characterizes a person's privacy, including in the sexual sphere.
