The statute of limitations in disputes on the recognition of transactions as invalid

Purpose: To study the specifics of the application of limitation of actions in disputes on the recognition of transactions as invalid in Russian civil law. Methodology: We used a formal legal method, normative and dogmatic analysis. Results: In this article, features of the application of limitation of actions in disputes on the recognition of transactions as invalid are analyzed. The importance of statute of limitations as an institution of Russian civil law is underlined. The main attention is paid to the problematic aspects in determining the limitation of actions in Russian civil law. The author draws attention to the complexity of determining the limitation periods, the existing contradictions in the Civil Code of the Russian Federation, and considers the issue of the possibility of applying limitation of actions by third parties. In the author’s opinion, the issues of applying limitation of actions in the Russian legislation need to be deepened and improved. Novelty/originality/value: This article is of considerable scientific and practical value, since it is devoted to the issue of limitation of actions in disputes on invalidity of transactions, important for Russian civil law. Resolution of existing contradictions is an important task in the direction of development and improvement of domestic civil legislation.
