Enforcement of the order on the forced expulsion of foreign nationals in the context of the COVID-19 pandemic

During the COVID-19 pandemic the legal status of foreign nationals and stateless persons who were in specialized institutions and subjected to administrative punishment in the form of forced expulsion from the territory of the Russian Federation was not regulated. The lack of established time limits related to the closure of state borders has led to the need to review the imposed additional penalties related to expulsion from the territory of the Russian Federation. Analyzing legislative changes during the period when restrictive measures were introduced, the author concludes that the existing problem in practice associated with determining the period of stay of foreign nationals and stateless persons in specialized institutions at the time of the introduction of restrictions has not been resolved by the legislator. The study of law enforcement practice has revealed the current approaches to resolving the situation regarding the execution of decisions on the forcible deportation of foreign nationals from the territory of the Russian Federation. The author analyzed changes in migration legislation in the new prevailing conditions in relation to foreign nationals and stateless persons who were in the territory of the Russian Federation and were identified after the introduction of restrictive measures.
