Use of technologies of remote participation of the victim in criminal proceedings

The article deals with the regulatory framework and the main directions of the digitalization of criminal proceedings, including the use of remote participation technologies in pre-trial and trial proceedings . The author analyzes existing mechanisms and prospects for improvement of legal regulation of victims’ remote participation in filing statements of crimes, sending other documents (complaints, petitions) in electronic form, using of video-conference communication, including during the investigation activities (interrogation, confrontation, identification) as well as in judicial proceedings with the amendments made by the Federal Laws No 501 of December 30, 2021 and No 610 of December 29, 2022 . The author emphasizes that for the victim the possibility of remote participation in the criminal process contributes to ensuring his access to justice, but procedural legislation in terms of regulation of the use of distance technology requires improvement . Automation of routine processes, use of modern means of information transfer, artificial intelligence - all these achievements of progress should not lead to a decrease in the guarantees of protection of the rights and legitimate interests of victims .
