Is the judicial resolution of IP disputes effective? Is there any alternative?

The article analyzes the specifics of cases on the protection of intellectual rights. The reasons, including the unpredictability of the result, are considered for which the judicial resolution of such disputes in most cases is not an effective form of protection of such rights. Methods of alternative dispute resolution are presented. Basic communication techniques are described. It is concluded that active mediation is the most applicable option for resolving the considered category of disputes.
