Excessive act, voluntary refusal of crime, failed complicity and positive post-criminal behavior in complicity with the distribution of roles: doctrinal interpretation and law enforcement practice

The scientific article examines the features of the doctrinal and law enforcement regulation of special issues of responsibility of accomplices in a complex form of complicity in a crime. The opinions of experts on models for improving legislation on this controversial topic are demonstrated. Based on the analysis of the views of scientists and judicial practice, the authors propose their own positions on the creation of a real mechanism for effective and high-quality legal regulation of excess, voluntary refusal of crime, the so-called «failed complicity» and positive post-criminal behavior in complicity with the distribution of roles.
