Legal liability for disrespect to the court: problems of legal regulation and practice of application

The article examines the problems of legal regulation and the practice of bringing to legal liability for contempt of court. The legal nature of the institution of criminal liability for insulting the court and other participants in the trial is considered. An interpretation is given of the concepts of «insult» and «publicity» in the application of criminal liability. A comparative analysis of the grounds and legal consequences of procedural liability for contempt of court in criminal, civil, administrative and arbitration proceedings is carried out. Attention is drawn to the distinction between the legal institutions of «contempt of court» and «abuse of law». It is concluded that it is necessary to legitimize the definition of «contempt of court» and introduce unified standards for bringing guilty persons to justice in Russian procedural law.
