Legal analysis of objective evidence abuse of office

The article is devoted to the signs of a crime under Art. 286 of the Criminal Code of the Russian Federation “Excess of official authority”. The subject of the research is the norms of criminal law, which regulate public relations, ensuring the normal functioning of the apparatus of public authority and administration in the Russian Federation, as well as the theoretical aspects of the science of criminal law. The aim of the study is to analyze the qualifying characteristics of the composition of Art. 286. The author considers the objective signs of a crime committed by officials. In the course of the study, general scientific methods of cognition were used: analysis and synthesis, as well as private scientific methods: comparative legal, formal logical and others. Sociological techniques were used, in particular, the study of judicial practice materials. The results were obtained in the form of the development of reasonable proposals for improving the legislation.
