To the notion of efficiency of application of civil laws

The article gives the consideration of general issues of the efficiency of application of civil laws. Certain theoretical and methodological aspects of the concept efficiency of application of civil laws are analyzed in this article. The notion of efficiency of application of civil laws is defined and influence factors of the given efficiency are formulated. The author offers a scientific definition of the notion efficiency of application of civil laws and characterizes the substance of the given notion. The correlation between the operation of civil legal rules and the application of civil legal rules is discovered through the legal content of the notion of efficiency. Issues of realization of the public legal policy in the civil circulation's sphere are taken up. These issues are brought up in connection with the problem of assessment of the efficiency of application of civil law. The author calls the law application examination of acts containing civil legal rules as one of the instruments of appraisal of the efficiency of application of civil laws. It is underlined that the basic goal of the public legal policy's realization in the civil legal sphere, as a constitutionally significant expression of the state's public will, is a high efficiency of application of civil legal rules. It is mentioned that the efficiency of application of civil legal rules designates a positive or negative social usefulness of one of the segments of the system of application of law, as an effect of the relationship between the juridical ability of the civil laws to generate the legal consequences (i.e. ability to operate) and the actual result of realization of these consequences (i.e. ability to be applied). It is accentuated that the positive dynamics of the development of private and public legal relationships is made conditional on the ability of state to form a qualitative legal strategy of coordination and control of the given relationships. The author concludes that legal policy, as an expression of the official position of public authority, demonstrates the real, actual attitude of state, represented by its superior and lower organs and officials, to natural and legal persons as participants of civil legal relationships; to base civil legal institutes; to civil rights' protecting by means of the sequential, organic, open and effective application of civil laws.
