Determining the legal nature of the agreement on tourist product realization

In the last decade, there has been a positive trend in the tourism legislation reforms; moreover, the legislator has eliminated previous shortcomings and conflicts. However, tourism legislation is still inconsistent and incomplete. On the contrary, in order to improve tourism laws and regulations, the legislator gives rise to the scientific controversy. These circumstances indicate the need for further research of the existing problems of tourism legal regulation, the development of a unified approach to their solution. A retrospective analysis of the contract structure regulating tourism service delivery shows the necessity to resolve conflicts made by the legislator in the agreement on tourist product realization. Otherwise, the legal nature of the agreement on tourist product realization is erroneously interpreted as the commission agreement rather than the services agreement.
