On the issue of the causal relationship in the family offence

In this article, the author notes that to bring the offender to justice according to the norms of family law does not always require a complete set of elements of the offense. Everyone knows that some of the common reasons of family-legal responsibility include: - unlawful conduct (action or inaction) of the person who is supposed to be blamed; - presence of a victim of harm or loss; - causal connection between the wrongful conduct of the offender and then comes the negative effects; - culpability of the offender. Responsibility in family law can arise when abridged, incomplete structure of the offense. Mandatory grounds of family-legal liability are two elements of the offense: the wrongful conduct of the subject of family relationships and his guilt. The author considers the causal link between the unlawful conduct and not of consequences to the mandatory grounds of family and legal liability. With the qualification of a particular family of the offense is one of the main tasks of the judiciary and other state agencies, is to select among all the circumstances, most importantly, the decisive factor that should be considered the cause. And in each case, an offense causing harm family has its own causal connection between the action of a family member, and the result of the come, as the causal relationship between the various phenomena is unique, so every result has a cause. Of course, the existence of a causal connection between the wrongful conduct and the subsequent actions of these malicious result, expressed in violation of rights of another family member, is one of the necessary conditions in order to entrust the responsibility of the offender for this malicious result. The author concludes that a cause and effect relationship is important in the classification of certain types of family offenses.
