On the question of expediency of exemption from criminal liability under articles 174 and 1741 of the Criminal Code of the Russian Federation

Introduction: the author discusses whether it makes sense to include a special provision on exemption from criminal liability in the crime of criminal money laundering established by Article 174 of the Criminal Code of the Russian Federation. Materials and Methods: the study materials were criminal norms, sentences of the courts of the Russian Federation under Articles 174 and 1741 of the Criminal Code of the Russian Federation, works on criminal law on issues of exemption from criminal liability and criminal liability for the money laundering. System and structural, normative and logical and statistical methods were used in the study. Results: the analysis of criminal norms, judicial practice and scientific study on criminal liability for the money laundering allowed us to come to the conclusion that it was necessary to consolidate in Article 174 of the Criminal Code of the Russian Federation the incentive norm on special grounds for exemption from criminal liability. Discussion and Conclusions: the author presents her own note to Article 174 of the Criminal Code of the Russian Federation on special form of the grounds for exemption from punishment.
