Towards the question of imperfection of Art. 146 of Russian Criminal Code: some lacks and ways of their overcoming

In the article there are considered the questions of imperfection of art. 146 Russian Criminal Code which regulates relations in the sphere of copyright and adjacent rights. In the author's opinion, the formulation of pt. 1 of the article is unacceptable, that leads to a reification of the non-property rights, in virtue of which is proposed to change the formulation in the disposition of the analyzed part of this article. During the analysis of Pt. 2 of Art. 146 of the Criminal Code the author of the article also comes to the motivated conclusion about the need to complement the disposition of this part.
