To the issue of awarding and recovering alimony in modern Russia

The issues related to alimony obligations of citizens who, according to family law, are obliged to pay maintenance to children and spouses, especially after divorce, remain topical in modern Russia. Life realities reveal the reluctance of the former spouse to use the right to receive alimony as one of such problems. This problem becomes especially acute when this refers to the maintenance of common children after divorce. Refusing to recover alimony for a minor, the parent living with him violates primarily the rights and legitimate interests of his own child. As measures that can change this situation, the author proposes to oblige the court during divorce proceedings not only to determine if there is no agreement on alimony payment, from which parent and in what amounts alimony is recovered on their children, but also to award alimony in court. In addition, the author shares the point of view according to which it is necessary to legally oblige the parent, with whom the child remains and who refuses to apply to court for alimony, to go to court, and for failing to comply with this requirement, to introduce responsibility.
