Purpose: Consideration of the contents of the procedural status of the person concerning which criminal prosecution is carried out. Methodology: The author applied a historical and legal method, a comparative and legal method, a formal legal method. Results: In article the scientific discussions which are conducted in recent years about optimization of the procedural status of the person which is exposed to criminal prosecution are analyzed. The convention of the use in the law of any terms and need of a priority of substantial, human rights sense of standard instructions in comparison with their formal expression is emphasized. Novelty/originality/value: Work is of the high scientific value as is attempt of complex reconsideration of questions of the maintenance of legal status of the person concerning which criminal prosecution is carried out.
