To the question of the implementation of the preventive function of administrative responsibility for the violations of customs regulations

This article is devoted to realization of the preventive function of administrative responsibility for violation of customs regulations. The statistics of the initiated cases on administrative offenses in the field of customs for the past five years are given and the tendency of their growth is revealed. Measures, aimed at preventing the commission of offenses in the field of customs, contained in administrative-tort legislation are considered and analyzed, their shortcomings are revealed, the additional measures for prevention of offenses in the sphere of customs are proposed, including the development of a single mechanism of appointment of punishment below the lowest limit, expansion of the list of articles, providing warning as an alternative measure of punishment and reducing the fine, increasing the practice of applying the institution of liberation from administrative punishment. The article concludes that the adoption of the above measures will allow for more effective state policy aimed at dealing with administrative offenses in the customs field.
