On the issue of electronic criminal case: the experience of foreign countries

The problem of introducing a system of electronic criminal cases is considered. In order to most fully disclose the main problems of using digital technologies in the criminal process, the experience of foreign countries is analyzed. The essence and content of the system of electronic criminal cases, the principles of its work are revealed. The conclusion is made that this system is an administrative and managerial tool for working with the electronic version of the criminal case materials, which are then available online for parties involved in the pre-trial stage of the criminal case. It also describes not only the positive aspects of the idea of creating electronic criminal cases, but also identifies and analyzes some problems that will inevitably arise on the way to implementing this idea. It is emphasized that the issue of ensuring the information security of the system occupies a special place in the process of implementing the draft electronic criminal cases. It is concluded that the widespread introduction of electronic criminal cases should be phased, balanced and systemic.
