On the Creating a Private Methodology to Investi- gate Labour Protection Requirements’ Violations that Caused the Death of a Person by Negligence

The rapid development of the Russian Federation, having positive dynamics and the necessary socio-economic effect, in some cases leads to victims with severe and fatal consequences, including labour protection requirements’ violations, resulting the death of a person by negligence. The article substantiates the reasons, prerequisites, criteria for the creation of a private methodology of the investigation the labour protection requirements’ violations that caused the death of a person by negligence; the methodology of cognition and the object-subject organisation of forensic research are also observed. Purpose: to identify the prerequisites and foundations for forming a private methodology to investigate labour protection requirements’ violations that resulted in the death of a person by negligence. Methods: mathematical analysis of official statistics, survey results of investigators (n=59), methods of interpretation and analogy, systematic, activity-based and situational approaches. Results: the necessity of creating a private methodology for investigating labour protection requirements’ violations that caused the death of a person by negligence is substantiated, a scientific problem and the main idea are put forward, and the object and subject of research are considered, the concept is presented on the basis of the fundamental laws of objective reality.
