On the issue of labour agreement place in the system of the sources of law

Labour agreement is a way of expression of the will of its parties. In the same time some scientists also considered labour agreement as a form (source) of law. Ukrainian legal system is approaching to the legal system of foreign countries, in particular, to the countries of Western Europe. In this connection Ukrainian legal system is in the process of development of new sources of law. Our scientists traditionally as a sources of law considered: legal custom, legal act, judicial precedent, treaty with normative characteristics, principle of law, legal ideas and doctrines. In many countries the list of Labour law sources of law is more extensive. Based on the analysis of some foreign countries legislation I. Kiselov names following sources of law: international conventions, which are ratified inside the country; labour legislation, collective agreements, judicial and arbitrary decisions, rules of inner work settlement, acts of administration, customs and labour agreements. Labour agreement is considered as a source of law in some countries (for example Turkey, Denmark), where the legislation is not main source of law and the most aspects of labour relations and work conditions are determines by the parties of individual labour agreement. Mutual agreements of the parties creates their rights and obligations in accordance of principle of freedom of treaty and in the same time creates legal norms, which are compulsory not only for parties of agreement. The author agrees with the scientists who considered labour agreement as an act of individual regulation – when the parties conclude labour agreement they carry out and applied labour legal norms. This conclusion author made on the basis of definition of norms of law. In legal science norm of law is formally obligatory rule of physical behavior which has general character, is established or sanctioned by the state, have to regulate public relations and its compulsory is provided by state organization. Conditions of labour agreement, as a rule, determine behavior of two parties, and are not obligatory for other person. The compulsory character of legal norms for many persons is the main feature which differ them from labour agreement. Author stressed that special role in development of discussion about the place of labour agreement among the sources of Labour law has investigations of prof. L.Yu. Bugrov.
