On the impact of international legal norms on the implementation of criminal prosecution in the Russian Federation

The article presents the results of a conceptual, comparative and practical analysis of modern problems of ensuring the rule of law and respect for human rights in criminal prosecution in the Russian Federation from the standpoint of compliance with state coercion and the application of law-limiting measures to the prescriptions of fundamental international normative legal acts. The issues of criminal prosecution are presented in the context of the core installations of international norms and regulations of Russian legislation. The main idea of the article is the thesis that guarantees of the rights and legitimate interests of the participants in the process involve the use of a viable state mechanism capable of ensuring them, even if officials carrying out criminal prosecution will have to assume an additional set of obligations. The proposed conclusions and recommendations of the author claim to be of some significance for law-making and law enforcement activities, while their objectivity is confirmed by the legal positions of the highest judicial bodies of the Russian Federation.
