The category «civil circulation» in private law of Russia and other post-Soviet states

Introduction: The article is devoted to the comparative analysis of legislative and doctrinal provisions of Russian and some post-Soviet states (Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Tajikistan, Ukraine, Uzbekistan) relating to the category «civil circulation». Purpose: to form a more complete understanding of the category «civil circulation» in order to work out its more precise definition. Methods: the research is based on general scientific and specific scientific methods, among which formal-legal and comparative legal ones were the most effective for drawing the final conclusions. Results: similarities and differences in the way the category “civil circulation” is presented in legislation and in its doctrinal interpretation in the abovementioned countries are revealed. The thesis about the supra-national nature of the problem of understanding civil circulation is justified. Conclusions: comparative legal method is ineffective in determining the content of legal categories (unlike studying certain legal institutions); one of the most important objectives of modern legal science is system development of a macro-legal conceptual framework, which, according to the author, includes the category «civil circulation».
