Compensation for moral harm caused by personal injury: practical results after 25 years of existence of the legal institution in the Russian Federation

Purpose: The aim of this study is to establish the extent to which the judicial practice of compensation for moral harm caused by personal injury confirms or refutes the main thesis of the study - the insufficiency of currently existing general criteria for determining a fair and reasonable size of such compensation. Methodology: Author used data of 2236 cases of compensation for moral harm collected in legal practices and law firms in the period from January 2015 to September 2017, as well as statistics of the Judicial Department at the Supreme Court of the Russian Federation on 14025 cases of compensation for moral harm caused by personal injury heard in courts of general jurisdiction in the period from 2016 to June 2017.
