The questions related to the peculiarities of legal regulation of the concession agreement as a mixed contract, its basic elements: elements of contract agreement and lease agreement are defined in the article. The review of the basic positions of the legal of the concession agreement is resulted and the conclusion about its mixed character taking into account the legal provisions and practice of district arbitration courts is proved in the article.
