Confiscation of instrument of an administrative offence: the issues of past arbitration court rulings

The problems of imposition of confiscation, as a punishment for committing an administrative offence are viewed in the article. The author analyses the ruling of the Constitutional Court of the RF, issued on the 25th of April 2011, establishing the fact that practice of confiscation of items that were used as an instrument of an offence and not belonging to the offender as a property is in contradiction to the Constitution. The question of grounds of imposition of the confiscation as an additional punishment is investigated regarding the materials of past arbitration court rulings.
