1936 USSR constitution: a model of "repressive constitutionalism"

Introduction: the article presents an analysis of the provisions of the 1936 Constitution of the USSR, the democratic nature of the Constitution is refuted, and the influence on the formation of Soviet constitutionalism is considered. Materials and Methods: in the course of working on the article, the following methods were used: logical-legal, comparative legal, historical-legal, analytical. Results: the analysis of the provisions of the Constitution of the USSR of 1936 was carried out, which showed their importance for the formation of a model of "repressive constitutionalism". The influence of "repressive constitutionalism" on the deformation of the entire state legal system during the period of the totalitarian regime in 1930-1940 was determined. Discussion and Conclusions: the conclusions of the study are formulated and suggestions are made on improving modern legislation to prohibit the justification of Stalinism and increase the level of the legal culture of society.
