Criminalistic characteristics of crimes under art. 330.2 of the Criminal Code of the Russian Federation

Purpose: To identify the specifics of the forensic characteristics of crimes under Art. 330.2 of the Criminal Code of the Russian Federation «Failure to comply with the obligation to file a notice of the presence of a citizen of the Russian Federation of the citizenship (nationality) of a foreign state or residence permit or other valid document confirming the right to permanently reside in a foreign country». Methodology: We used a formal legal method, a method of comparative analysis. Results: In this article, the specificity of the forensic characterization of crimes under Art. 330.2 of the Criminal Code. The author draws a conclusion about the importance of this article for ensuring the national security of the Russian state and refers to the characteristics of the criminalistic characteristics of this type of crime. In particular, the article reveals the main features of the crimes committed, the characteristics of the personality of the subjects of criminal activity are examined. Special attention is paid to the analysis of the motivation for committing this crime. Also, the author draws attention to the problematic aspects of the legislation, which may create obstacles for the qualification of crimes under Art. 330.2 of the Criminal Code. Novelty/originality/value: The article has a scientific value, since it highlights the actual and poorly studied problem of investigating crimes under Art. 330.2 of the Criminal Code. This allows to develop and improve the work of investigation and operational bodies in the direction of investigating similar crimes.
