Forensic view on the formalization of the evidencing procedure

The author believes that the emergence of simplified procedures of preliminary investigation and judicial examination, the possibility of delivering judgement without the subsequent control of the sentencing legality in the part of accurate ascertainment of the presence of proof facts, may lead to the failure of a judge to comply with the law concerning the examination and evaluation of evidences. Such an approach to the judge's right to not reflect the evidence's examination and evaluation in the verdict, with remaining observance of other formal requirements for the descriptive and motivation part of the sentence, releases the judge from the liability for failure to verify the validity of the charges. The article proposes to supplement the existing law in this part. The due reasoning of the proposals is also presented.
