Criminalizing the promotion of terrorism in the Criminal Code of the Russian Federation and international instruments

The study discusses the criminalization of the promotion of terrorism, analyzes the conventional rules that provide liability for terrorist offenses, and investigates their compliance with the corresponding provisions of the Russian criminal law, i.e. the implementing rules of the Criminal Code of the Russian Federation. The paper deals with the criminal legal characteristics of promoting terrorism and analyzes the forms of this crime. The elements of the corpus delicti of this crime are considered from the perspective of international legal regulations prohibiting this act at the supranational level. The authors conclude that the provisions of the Russian criminal law generally comply with the stipulations of international criminal law, i.e. the relevant conventional rules that are mandatory for Russia are properly implemented in the Criminal Code of the Russian Federation. However, international criminal law prohibiting the promotion of terrorism is rapidly evolving and overtaking the Russian law; therefore, there seems to be a huge number of different forms of assistance at the international level compared to the Russian one today. The study provides several critical comments on the structure and content of Article 205.1 of the Criminal Code of the Russian Federation.
