Penitentiary crime is a component of the general crime and, respectively, is generated by similar determinants, but at the same time possesses unique features. They are defined by specificity of functioning of the penal system which is expressed in activities of bodies of Federal Penal Service of Russia for execution of the purposes of criminal sanction, the identity of convicts, existence of informal rules of conduct, etc. From our point of view, the most socially dangerous crimes are those against life and health. At the same time it is known that in comparison with punishment the idea of prevention is represented as the most perspective and progressive. For this reason it is more effective to prevent any criminal behavior, carrying out preventive measures, than to apply tough punishments.
